Terms & Conditions
These Terms and Conditions ("Terms") govern your use of this website and your engagement of travel planning services from David Bragg Travel ("DBT," "I," "me," or "my"), an independent affiliate of SmartFlyer. By using this website or engaging my services, you ("Client," "you," or "your") agree to be bound by these Terms. Please read them carefully. These Terms include disclaimers of warranty and limitations of liability that affect your legal rights, so if any part of them is unacceptable to you, please do not use this website or my services.
1. Agent Disclosure
I act solely as a booking agent for disclosed, independent suppliers, including hotels, airlines, tour operators, cruise lines, ground transportation providers, and other third parties providing travel-related goods and services ("Suppliers"). I am not the source or provider of any travel service, and each Supplier is an independent business not under my control. Separate Supplier terms and conditions apply to your reservation and purchase of each travel component, and by booking through me, you also agree to the terms of each Supplier you select.
2. Use of My Services
You represent that you are at least 18 years old and have the legal authority to make travel bookings, for yourself and, if applicable, on behalf of members of your travel party. You agree to be financially responsible for all bookings made on your behalf. You warrant that all information you provide is true and accurate, and that you will only request legitimate reservations, no speculative, false, or fraudulent bookings.
3. Right to Correct Errors; Availability
I reserve the right to correct pricing errors or omissions. All offers and Supplier promotions are subject to availability and may change without notice. I recommend confirming travel plans well in advance, as pricing and availability may change, and late bookings may carry additional fees.
4. Payments, Cancellations & Changes
Planning fees are described on my Planning Fees page and are separate from the cost of your trip. All payments for travel components are due according to each Supplier's terms. In many cases, deposits and full payments are non-refundable once made, and confirmed bookings may not be eligible for a refund if changed or cancelled. All cancellation or change requests must be made to me in writing. Cancellation and change penalties imposed by Suppliers, along with any applicable DBT planning fee for rebooking or reworking an itinerary, will apply and will be charged to the payment method on file. If travel components are priced under group or contracted rates, no refund will be issued for any unused portion of the trip.
5. Travel Documents
You are responsible for obtaining and carrying a valid passport, any required visas, and all other documents required by applicable government regulations, for every member of your travel party. The Transportation Security Administration (TSA) and Department of Homeland Security (DHS) require acceptable identification to board a flight; the name, date of birth, and gender on your identification must exactly match your airline ticket and booking record. Some countries will not admit travelers whose passport expires within six months of the return date. Minors traveling with only one parent, or without either parent, may require additional consent documentation. It is your responsibility to verify these requirements before travel; I am not responsible for denied boarding, missed flights, or other consequences resulting from inaccurate or insufficient documentation.
6. Entry & Exit Requirements
Each country has its own entry and exit requirements, including with respect to prior criminal history. It is your responsibility to confirm your eligibility to enter each destination on your itinerary, including by contacting the relevant country directly if needed. I do not inquire about clients' criminal history out of respect for your privacy.
7. Health & Immunizations
You are responsible for obtaining any immunizations, health screenings, and related documentation required for your destination(s), and for checking with your own health practitioner before travel. I do not warrant the accuracy of health or vaccination requirements and recommend confirming current guidance with the U.S. State Department (travel.state.gov) and the CDC (cdc.gov/travel).
8. Risks & Safety
Travel to certain destinations carries greater risk than others. I encourage you to review current government travel advisories before booking international travel, and to enroll in the State Department's Smart Traveler Enrollment Program (STEP) at step.state.gov. Laws, customs, and safety conditions vary by country, including with respect to LGBTQ+ travelers, and it is your responsibility to research conditions relevant to you and your travel party before booking. I do not represent that travel to any destination is advisable or without risk, and your participation constitutes acceptance of these risks.
9. Hazardous Materials & Insecticide Notice
Federal law prohibits carrying hazardous materials, including certain paints, fireworks, and pressurized containers, aboard aircraft; violations may carry criminal penalties. Some countries require aircraft cabins to be treated with insecticide before or during flight; current requirements are listed on the U.S. DOT website.
10. Air Travel, Check-In & Reconfirmation
Your airline ticket is a contract between you and the airline; I act only as a booking agent and am not liable for airline errors, delays, schedule changes, cancellations, or policies regarding baggage, refunds, or rebooking. I recommend checking in at least 2 hours before domestic departures and 3 hours before international departures, and reconfirming flight times 24 hours (domestic) or 72 hours (international) in advance. Frequent flyer accrual, upgrades, and seat assignments are at each airline's discretion. E-tickets generally expire one year from issuance unless fare rules provide otherwise.
11. Group & Minimum Numbers
Some group tours and departures are based on a minimum number of participants. If the number of travelers falls below the required minimum, a surcharge may apply or the trip may be cancelled or restructured by the Supplier.
12. Limitations of Responsibility
Because I act as agent for independent, disclosed Suppliers and do not control their operations, I am not liable for any injury, property damage, delay, or other loss arising from the acts, errors, omissions, negligence, insolvency, or cessation of operations of any Supplier or its employees or agents. To the fullest extent permitted by law, I disclaim liability for direct, incidental, consequential, or punitive damages in connection with services provided by any Supplier. Because I receive only commission and fees for the travel arrangements I make, you agree that any recovery against me is limited to the amount of commission and fees I actually received in connection with your booking.
13. Force Majeure
I am not responsible for any failure or delay in performing my obligations due to causes beyond my reasonable control, including acts of God, war, terrorism, epidemic or pandemic, government action, civil unrest, extreme weather, or failure of communications or technology providers. In such events, Suppliers may cancel, postpone, or alter itineraries at their discretion, and any refund remains subject to the applicable Supplier's policies. Travel insurance is strongly recommended to protect against these risks.
14. Client Conduct
You are responsible for any damage or loss you cause during travel, and for any costs associated with your conduct, including removal from a tour or activity due to your own actions. Illegal possession or use of drugs may result in immediate termination of your trip. You are responsible for knowing and complying with all applicable drug and other laws at your destination(s).
15. Currency Fluctuations
Prices may be affected by currency exchange rate fluctuations. I am not responsible for foreign transaction fees or surcharges imposed by your bank or card issuer.
16. Travel Insurance
Travel insurance is not included in the cost of your trip unless specifically stated, and can help protect against Supplier default, trip interruption or cancellation, medical emergencies, and lost or delayed baggage, among other risks. I am not a licensed insurance broker, and cannot advise on the specific terms, exclusions, or adequacy of any policy. If you decline to purchase travel insurance, I may ask you to acknowledge that decision in writing. It is your responsibility to understand what your policy covers.
17. Photographs & Content
I may photograph or video moments from client trips, and may share these on my website or social media (including #braggageclaim) for marketing purposes. If you prefer that images including you or your travel party not be used this way, please let me know in writing before your trip.
18. Governing Law; Claims
These Terms are governed by the laws of the State of Tennessee. Any dispute arising from these Terms or my services shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee. Any claim must be brought within twelve (12) months of the completion of your trip. You agree to bring claims only in your individual capacity, and waive any right to participate in a class or representative action.
19. Changes to These Terms
I may update these Terms at any time; changes are effective when posted to this website. Continued use of my services after changes are posted constitutes acceptance of the updated Terms.
20. General
If any part of these Terms is found unenforceable, the remaining provisions will continue in full effect, and the unenforceable provision will be replaced with one that most closely reflects its original intent. These Terms, together with any signed Client Agreement, constitute the entire agreement between you and me regarding your travel booking.
